Privacy Policy
Last updated: October 19, 2026
Draft for review. This is a plain-English draft, not legal advice. Items marked [PLACEHOLDER] still need to be filled in.
This Privacy Policy explains what information Petagotchi collects when you visit our website or order a custom pixel pet, how we use it, who we share it with, and the choices you have. Petagotchi is operated by [PLACEHOLDER: legal business name, e.g. APX Growth LLC] ("Petagotchi", "we", "us").
1. Who we are
Petagotchi makes personalized digital pixel pets: a web app game made from your pet's photos, sold for $49 one-time. It runs in the browser on iPhone and Android and can be added to your home screen, with no app download. Everything is digital; nothing is physically shipped.
[PLACEHOLDER: legal business name, e.g. APX Growth LLC] is responsible for your personal information as described in this policy (in the EU and UK, this makes us the "controller"). You can reach us at [PLACEHOLDER: contact email] or by post at [PLACEHOLDER: business postal address].
2. Information we collect
Information you give us
- Order and payment details. When you buy, you check out through a Stripe Payment Link. Stripe collects your payment card details and billing information. We receive order details from Stripe, such as your name, email address, the amount paid and the payment status. We do not see or store your full card number.
- Pet details and photos. After checkout, you fill in a Tally form with your pet's information and photos (for example your pet's name, type or breed, notes about their looks and personality, and your contact email). Tally stores what you submit on our behalf.
- Order form. We may also use a backup order form that emails your order details to us through FormSubmit. It can include your email, your pet's name and type, whether it's a gift, and any note you add.
- Messages. If you email us (for example about a revision or a refund), we keep the message and your email address.
Information collected automatically
- Hosting logs. Our website is hosted on Cloudflare Pages (and on Surge while we move over). Like most hosts, they process technical data such as your IP address, browser type and the pages requested, to deliver and protect the site.
- Cookies and similar technologies. We may use Google Analytics, the Meta (Facebook/Instagram) Pixel and the TikTok Pixel [PLACEHOLDER: confirm whether the TikTok Pixel is used]. These use cookies, pixels and similar technology to collect information such as the pages you view, the buttons you click (for example "Make yours"), whether you complete a purchase, your browser and device type, an approximate location based on your IP address, and identifiers that link your visit to your ad accounts. See Cookies, analytics and advertising.
Information stored on your device
Your pixel pet game saves its progress (such as care stats, streaks and unlocks) in your browser's storage on your device, which is how it works offline. It isn't linked to an account, and we do not receive this game data. Clearing your browser's website data, deleting the home-screen app or switching devices may erase this progress.
3. How we use your information
- To create and deliver your pixel pet, including your one free revision.
- To process payments and refunds, and to deactivate access if a refund is given.
- To email you about your order and answer your questions.
- To run, secure and improve our website and game.
- To measure how our site and ads perform, and to show our ads to people who visited our site or who are similar to our customers (see below).
- To keep records we need for accounting, tax and legal reasons, and to prevent fraud or misuse.
4. Your pet photos
We use the photos and pet details you send us to create your pixel pet, its custom pixel art and its app icon. We will only feature your pet in our marketing if you give us permission.
You can ask us to delete your photos at any time, including right after delivery (see How long we keep information).
5. Cookies, analytics and advertising
We may use these third-party tools on our website:
- Google Analytics, to understand how visitors use the site.
- Meta Pixel (Facebook and Instagram), to measure our ads, and to build ad audiences so we can show our ads to people who visited our site (retargeting).
- TikTok Pixel [PLACEHOLDER: confirm whether used], for the same ad measurement and audience purposes on TikTok.
These providers may combine information about your visit with other information they hold about you, under their own privacy policies.
Your choices
- Browser settings: you can block or delete cookies in your browser settings. Some browsers also block third-party trackers by default.
- Google Analytics: install the Google Analytics opt-out browser add-on.
- Meta: manage how Meta uses data from other websites for ads in your Meta ad preferences.
- TikTok: manage ad personalisation in the ad settings of your TikTok account.
- Industry opt-out: use YourAdChoices to opt out of interest-based ads from participating companies.
- Global Privacy Control: if your browser or extension sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of "sharing" for cross-context behavioral advertising for that browser.
Opting out of ads means the ads you see are less tailored, not that you see no ads.
6. Who we share information with
We don't sell your personal information for money. We share it only as needed with:
- Service providers who help us run Petagotchi: Stripe (payments), Tally (pet info and photo uploads), FormSubmit (backup order form emails), Cloudflare and Surge (website hosting), and our email provider.
- Analytics and advertising partners: Google, Meta and TikTok, as described above.
- Legal and safety: when the law requires it, or to protect our rights, our customers or others.
- Business changes: if our business is sold, merged or reorganised, to the new owner, who must protect your information in line with this policy.
7. How long we keep information
We keep information only as long as we need it. Unless you ask us to delete it sooner:
- Pet photos and pet details: kept while we make your pixel pet and through your revision and refund window, then deleted within [PLACEHOLDER: number of days, e.g. 90] days of delivery.
- Order and payment records: kept for [PLACEHOLDER: period, e.g. 7 years] for tax and accounting.
- Emails with you: kept for [PLACEHOLDER: period, e.g. 2 years] after your last message.
- Analytics and ad data: kept according to each provider's settings [PLACEHOLDER: e.g. Google Analytics retention set to 14 months].
You can ask us to delete your information at any time by emailing [PLACEHOLDER: contact email]. We'll delete it unless we need to keep some of it by law (for example, payment records). Stripe and other providers may keep records under their own legal obligations.
8. Security
We use reputable providers and reasonable safeguards to protect your information, and payments are handled by Stripe so we never store your card number. No website or online service is completely secure, so we can't guarantee absolute security. If you think your information has been misused, please contact us.
9. International transfers
We and our providers may store and process information in the United States and other countries, which may have different data protection laws from where you live. Where the law requires it (for example for transfers from the EU or UK), we rely on appropriate safeguards such as the standard contractual clauses our providers offer. [PLACEHOLDER: confirm where the business and its data are based]
10. Your choices and rights
Wherever you live, you can email [PLACEHOLDER: contact email] to ask for a copy of your information, to correct it, or to delete it. We may need to confirm your identity (for example, from the email address you ordered with) before acting on a request. We won't treat you differently for using your privacy rights.
11. California privacy rights (CCPA/CPRA)
If you live in California, you have the right to:
- Know what personal information we collect, use and disclose, and get a copy of it.
- Delete personal information we collected from you, subject to legal exceptions.
- Correct inaccurate personal information.
- Opt out of "sale" or "sharing" of your personal information.
- Limit use of sensitive personal information. We don't use sensitive personal information for purposes that require this right.
- Not be discriminated against for using these rights.
Selling and sharing. We don't sell personal information for money. However, the Meta Pixel, Google tools and TikTok Pixel [PLACEHOLDER: confirm whether used] on our site may count as "sharing" personal information (such as identifiers, browsing activity on our site and purchase events) for cross-context behavioral advertising under California law. To opt out, email [PLACEHOLDER: contact email] with the subject "Do Not Share", turn on Global Privacy Control in your browser, or use the choices in Cookies, analytics and advertising. We don't knowingly sell or share the personal information of anyone under 16.
Categories we collect (in the past 12 months): identifiers (name, email, IP address, cookie and ad identifiers); commercial information (purchases); internet activity (pages viewed and clicks on our site); approximate location from IP address; photos and descriptions of your pet you choose to send; and inferences ad partners may draw for advertising. Sources, purposes, recipients and retention are described in the sections above.
You or an authorised agent can make a request by emailing [PLACEHOLDER: contact email]. We'll confirm your request and respond within the time the law requires.
12. EEA and UK privacy rights (GDPR)
If you live in the European Economic Area or the United Kingdom, we use your information on these legal bases:
- Contract: to create and deliver your pixel pet and handle your order, revision and refund.
- Legitimate interests: to run, secure and improve our site and answer your messages.
- Consent: for non-essential cookies, analytics and advertising pixels where the law requires consent, and to feature your pet in our marketing. You can withdraw consent at any time.
- Legal obligation: to keep tax and accounting records.
You have the right to access, correct, delete, restrict or object to our use of your information, to data portability, and to withdraw consent. Email [PLACEHOLDER: contact email] to use these rights. You can also complain to your local data protection authority (in the UK, the Information Commissioner's Office). [PLACEHOLDER: EU/UK representative, if required]
13. Children
Petagotchi is not directed to children under 13, and we don't knowingly collect personal information from children under 13. Orders must be placed by an adult. If you believe a child has sent us personal information, contact us at [PLACEHOLDER: contact email] and we'll delete it.
14. Changes to this policy
We may update this policy from time to time. When we do, we'll change the "Last updated" date at the top, and if the changes are significant we'll take reasonable steps to let you know.
